Public Access File (“PAF”)

Public Access Files (PAF) is an important and critical legal document. Companies holding H1B, H1B1, and E-3 statuses are held to certain requirements as per the underlying labor condition applications (LCAs) filed with the U.S. Department of Labor (DOL). One such requirement is to maintain a file that is available for public inspection, which is referred to as the Public Access File (PAF).

PAF file must include:

1. Completed LCA form and cover pages.
2. Wage rate to be paid to H-1B non-immigrant’s.
3. Actual wage pay system memorandum.
4. Prevailing wage documentation. = OES Library page to be kept PAF.
5. A copy of notification given to a union or employees.
6. Benefits information.
7. Merger specific information.
8. Dependent or Willful Violator or Single Employer information.

PAF must be kept for one year after the employee has been terminated or one year after the expiration of the LCA if no non-immigrants were employed under the said LCA.
